Katherine was able to enter the house because Elena had died. So it isn't her house anymore. Just in one episode were Damon and Stefan killed the last family member of a house, so they could enter. It is just the same as when Katherine was able to get out of the cave because Elija died. The compulsion was lifted.

My guess would be that Elena needed Katherine to save Damon so she wasn't really thinking about the whole not inviting her in the house, she was thinking more about Damon.

i think that's dumb. She did die, but she came back. so she isn't dead anymore. so really Damon and Stefan should have had to be reinvited in. since it is now Elena's house, the only vampires that have been invited in are Damon and Stefan no one else.

At first I agreed with Marty_84 but after I thought about it some more, I don't. The reason why vampires have to be invited in by her is because the house is in her name. It isn't the same compulsion that kept Katherine in the tomb. Its not the same thing. It is also not the same thing as the time Damon killed the owner of another house. Because that person stayed dead. Once Elena came back to life, she went back to being the owner. So even though she died, its not like they reported it and her house was taken away from her. Her name is still signed on the deed, it is still her house. I think it was a mistake by the director/writers of the show. That's all.

I agree with Marty_84. When Elena was sacrificed during Klau’s ritual she died, yes she came back later, but she technically died. Her death undid her ownership of the Salavatore house and that’s how Katherine was able to enter without invitation.

How about this:
I think that magically (and actually legally unless I’m mistaken) in a contract like ownership of a house the text will say something like “upon death the property will transfer to the next of kin (unless someone specific is designated)” and I doubt Stefan and Damon went to any trouble to plan out who owns the house after Elena so it was probably whatever is standard boilerplate for a contract. At the moment of Elena’s death, however temporary, the property would transfer legally and magically to next of kin. Jeremy is a minor. Jenna, legal guardian and aunt dies just before Elena. The next of kin is John Gilbert - who subsequently dies without an heir.
Would he have had a will that left his property to Elena? Jeremy (who also dies once before Kathrine enters the boarding house uninvited)? Miranda Gilbert’s charity? Perhaps it would go to probate as he was not married and has no known children and no one would own the house for a while?
It doesn’t have to be perfect. Just has to be plausible to avoid a plot mistake. What do you think?
