I think that magically (and actually legally unless I’m mistaken) in a contract like ownership of a house the text will say something like “upon death the property will transfer to the next of kin (unless someone specific is designated)” and I doubt Stefan and Damon went to any trouble to plan out who owns the house after Elena so it was probably whatever is standard boilerplate for a contract. At the moment of Elena’s death, however temporary, the property would transfer legally and magically to next of kin. Jeremy is a minor. Jenna, legal guardian and aunt dies just before Elena. The next of kin is John Gilbert - who subsequently dies without an heir.
Would he have had a will that left his property to Elena? Jeremy (who also dies once before Kathrine enters the boarding house uninvited)? Miranda Gilbert’s charity? Perhaps it would go to probate as he was not married and has no known children and no one would own the house for a while?
It doesn’t have to be perfect. Just has to be plausible to avoid a plot mistake. What do you think?
